ILLINOIS — As Illinois cities grapple with people experiencing homelessness, some law enforcement agencies are concerned with how the state’s SAFE-T act will impact their ability to address trespassers.

After the Illinois Supreme Court upheld the SAFE-T Act’s no cash bail provision, they set an implementation date of Sept. 18. During Tuesday’s Springfield City Council meeting, Springfield Police Chief Ken Scarlette warned that police can only do so much when someone trespasses.

Scarlette warned that scenario could get worse with the Pretrial Fairness Act. Gov. J.B. Pritzker said that’s incorrect.

While the measure was modified late last year, those found trespassing must first be issued a ticket and if they don’t leave the premises, they then can be arrested.
